In that case, the defendant could just assert his Sixth Amendment right to a jury trial without being worse off.The Department of "Justice" has been working hard on eviscerating the obstructive Civil Right amendments of the Constitution (not just the Sixth), and it would be a major setback if prosecutors were limited to reasonable charges.It is important for the scheduling of legal, penitential, and career relevant resources that the outcome of a process can be planned ahead with sufficient reliability. The ability of a prosecutor to throw the book at people not willing to accept their scheduled charges is an important part of maintaining a reasonable throughput and dependable restocking of penitentiaries.
